By accessing our website, purchasing products, subscribing to our software, or using our services, you agree to be bound by these Terms.

Services and Products

Agans Executive provides recruiting-related products and services, including but not limited to:

- Recruiting support services

- Recruiting consultation

- Applicant Tracking System (ATS) subscriptions

- Client Relationship Management (CRM) software subscriptions

- Recruiting professionals and support services

- Digital resources and templates

- Print-on-demand recruiting materials and promotional products

The specific products or services you receive will be outlined in your order, subscription, invoice, proposal, or service agreement.

Print-on-Demand Products

Our online shop offers custom print-on-demand products that are manufactured and fulfilled by third-party production partners through Printify.

Because each item is produced specifically after an order is placed:

- Production and shipping times are estimates and may vary.

- Product colors, sizing, and placement may vary slightly from digital mockups.

- We are not responsible for delays caused by shipping carriers, weather, customs, or circumstances outside our control.

If you receive a damaged, defective, or incorrect item, please contact us promptly so we can work with our fulfillment partner to resolve the issue.

Client Responsibilities

You agree to:

- Provide accurate and complete information for products and services requested.

- Provide accurate billing and shipping information when placing orders.

- Respond promptly to requests related to recruiting services or active projects.

- Use any ATS or CRM access solely for legitimate business purposes.

- Maintain the confidentiality of your account credentials and notify us of any unauthorized use.

Payments & Fees

Fees for products, subscriptions, and services are disclosed before purchase.

Recurring ATS, CRM, and subscription services are billed in advance according to your selected billing cycle. Subscription fees are non-refundable unless otherwise required by law or stated in a separate written agreement.

Physical product prices, shipping charges, and applicable taxes are calculated during checkout.

Failure to make timely payments may result in suspension or termination of services or subscriptions.

Returns & Refunds
Due to the custom nature of print-on-demand products, returns and exchanges are generally not accepted for buyer's remorse, incorrect size selection, or ordering mistakes.

If your order arrives damaged, defective, or materially different from what was ordered, please contact us within a reasonable period after delivery so we can review the issue and, when appropriate, arrange a replacement or refund.

Service fees and subscription payments are subject to the terms of the applicable service agreement and are generally non-refundable.

Confidentiality

We respect the confidentiality of client and candidate information. Both parties agree not to disclose confidential information except as necessary to perform the services or as required by law.

No Guarantee of Results

Recruiting outcomes depend on numerous factors beyond our control. While we strive to provide effective recruiting support and systems, we do not guarantee interviews, hires, candidate acceptance, employee performance, retention, or specific business results.

Intellectual Property

Unless otherwise stated in writing, all content, systems, workflows, software configurations, templates, graphics, branding, and other materials provided by Agans Executive remain our intellectual property.

You receive a limited, non-exclusive, non-transferable license to use purchased products or subscribed services for their intended business purposes. You may not copy, redistribute, resell, or reproduce our proprietary materials without prior written permission.

Third-Party Services
Some services and products rely on third-party providers, including payment processors, software platforms, shipping carriers, and print fulfillment partners. We are not responsible

for service interruptions, delays, or errors caused by third-party providers.

Termination

Either party may terminate service agreements in accordance with the applicable contract or written agreement. Upon termination:

- Outstanding balances remain due.

- Access to subscription platforms and services may be revoked.

- Any termination provisions contained within a separate service agreement will control where applicable.

Limitation of Liability

To the fullest extent permitted by law, Agans Executive shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our products, software, website, or services.

Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Alabama, without regard to its conflict of law principles.

Changes to These Terms
We reserve the right to update these Terms at any time. Changes become effective upon posting to our website. Continued use of our website, products, or services after updates constitutes acceptance of the revised Terms.
